1. Introduction

These Terms and Conditions govern the use of Prism, an AI-powered tool provided by People Insight, for the analysis of comments and feedback data. By using Prism, the organisation agrees to the terms outlined herein.


2. Data privacy and security

  • Anonymisation and PII Redaction: All data processed by Prism is anonymised, and personally identifiable information (PII) is redacted prior to analysis to ensure privacy and compliance with data protection regulations such as GDPR.

  • Encryption: Data is encrypted during transfer and at rest using industry-standard protocols to prevent unauthorised access.

  • No retention by third parties: Third-party tools involved in Prism's operations do not store or retain any data. Data is processed on a time-limited basis, and no information is used for purposes outside the agreed scope.


3. Data usage and ownership

  • Restricted Use: Data processed through Prism is used solely for the purpose of comment analysis as requested by the organisation. It will not be used to train AI models or for any purpose beyond the agreed scope.

  • Ownership: The organisation retains full ownership of its data and any insights or outputs generated through Prism. People Insight owns the Prism tool, its methodologies, and underlying technologies.


4. Transparency and methodology

  • People Insight is committed to transparency in the operation of Prism. Detailed documentation about the analysis process, including methodologies, parameters, and assumptions, is available upon request.

  • Insights and results are delivered in a clear and actionable format, designed to aid decision-making and organisational improvement.


5. Bias mitigation and ethical considerations

  • Prism’s AI is regularly reviewed and updated to minimise bias and ensure fair, accurate analysis.

  • Ethical AI practices are central to Prism’s operations, with clear oversight to maintain compliance with industry standards and best practices.


6. Dataset size and requirements

  • Prism is optimised for datasets of 200 or more comments to ensure meaningful and accurate analysis.

  • Smaller datasets may result in reduced reliability, and organisations are encouraged to meet this minimum size for optimal results.


7. Data security

  • Data security is a core priority for People Insight. Robust measures are in place to safeguard data throughout its lifecycle, including:

    • Secure access controls to prevent unauthorised use.

    • Encryption at all stages of processing.

    • Regular security audits and compliance checks.


8. Fair and appropriate Usage

  • Prism is designed for analysing textual feedback within professional and organisational contexts.

  • The organisation must not use Prism for any unlawful, unethical, or discriminatory purposes.

  • People Insight reserves the right to suspend or terminate access if Prism is used in ways that breach these terms or violate applicable laws.


9. Non-deterministic AI outputs

  • Prism’s AI is not deterministic and may produce errors, misclassifications, or unexpected results. While the tool is designed to minimise inaccuracies, results should be interpreted as part of broader human judgment and decision-making.

  • People Insight recommends users verify outputs against context and organisational expertise.


10. Limitation of liability

  • Prism is provided "as is" and "as available" without warranties of any kind, either express or implied.

  • People Insight will not be held liable for any indirect, incidental, consequential, or punitive damages arising from the use of Prism, including decisions made based on its outputs.

  • The organisation agrees to use Prism at its own risk, understanding its limitations as an AI-powered tool.


11. Fair usage policy

  • Access to Prism is subject to a fair usage policy. Excessive or abusive use that significantly exceeds the average usage patterns of other clients may result in throttling, suspension, or additional charges.

  • People Insight will notify the organisation in advance if usage patterns breach the fair usage policy and discuss appropriate actions.


12. Governing law and dispute resolution

  • These terms are governed by the laws of England.

  • Any disputes arising from these terms will be resolved through mediation in the first instance. If unresolved, disputes may be referred to the courts of England.


13. Modifications to the terms

  • People Insight reserves the right to modify these Terms and Conditions to reflect changes in laws, technology, or business practices.

  • Any changes will be communicated to the organisation in advance, and continued use of Prism will constitute acceptance of the updated terms.
